These Terms of Service ("Terms") form a legally binding agreement between you and Drawlio ("we," "us," or "our") and govern your access to and use of the Drawlio mobile application and any related services (collectively, the "App").
By downloading, installing, or using the App you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the App.
1. About the App
Drawlio is a mobile application that provides a curated library of drawing references and tools designed to help users learn, practice, and create artwork. Some features may require network connectivity, device capabilities such as a camera, or a paid subscription.
2. Eligibility
The App is available to users of all ages. If you are under the age of 13 (or the minimum age required in your jurisdiction), you may use the App only under the supervision of a parent or legal guardian who accepts these Terms on your behalf. By using the App you represent that you are legally capable of entering into a binding agreement under the laws of your jurisdiction.
3. License to Use the App
We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on Apple devices that you own or control, solely for your personal, non-commercial use and subject to these Terms and the Apple Media Services Terms and Conditions.
4. Restrictions
You agree not to:
- Copy, modify, adapt, translate, or create derivative works of the App
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App or any underlying technology, except to the extent such activity is expressly permitted by applicable law
- Rent, lease, lend, sell, sublicense, redistribute, or otherwise transfer the App or any portion of it to any third party
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
- Use the App in any manner that violates applicable law or regulation, or the rights of any third party
- Attempt to interfere with, compromise, or circumvent any security mechanism of the App, our systems, or our service providers
- Use the App to create, upload, or generate content that is unlawful, infringing, defamatory, abusive, or otherwise objectionable
5. Subscriptions and In-App Purchases
5.1 Available Plans
The App offers one or more optional paid plans that unlock additional features ("Drawlio Pro"). Available plans may include auto-renewing subscriptions with free or introductory offers and non-consumable one-time purchases, each with pricing and terms displayed in the App prior to purchase.
5.2 Billing and Auto-Renewal
All payments are processed by Apple through your Apple ID. By completing a purchase you agree to the following:
- Payment is charged to your Apple ID at the time of purchase confirmation.
- Auto-renewing subscriptions automatically renew for the same period and at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage your subscription or turn off auto-renewal at any time in Settings → [your name] → Subscriptions on your Apple device.
- Non-consumable one-time purchases (such as lifetime plans) are a single payment with no recurring charges and cannot be cancelled.
5.3 Free Trials and Introductory Offers
Where a free trial or introductory price is offered, eligibility is determined by Apple based on your Apple ID's history with the subscription group. If you do not cancel before the end of the free trial or introductory period, your subscription will automatically convert to a paid subscription at the standard price shown in the App.
5.4 Refunds
All refund requests are handled by Apple in accordance with Apple's refund policy. To request a refund, visit reportaproblem.apple.com. Drawlio does not have the ability to issue refunds directly for App Store purchases.
5.5 Price Changes
We may change subscription prices from time to time. Any price change will take effect at the start of the next billing period following the change and will be communicated in advance in accordance with Apple's policies. Continued use of the subscription after a price change becomes effective constitutes acceptance of the new price.
6. Your Content
Any photos you import into the App, artwork you generate, and time-lapse recordings you save are collectively referred to as "Your Content." You retain all ownership rights in Your Content. Your Content is stored locally on your device and is not uploaded to our servers.
By using the App you represent and warrant that:
- You own Your Content, or you have obtained all necessary rights and permissions to use it within the App
- Your Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party
- Your Content complies with all applicable laws and these Terms
You grant us a limited, non-exclusive, royalty-free license to process Your Content on your device solely for the purpose of providing the App's features to you. This license terminates when you delete Your Content or uninstall the App.
7. Intellectual Property
The App and all of its content, including but not limited to software, source code, artwork, drawing references, templates, graphics, logos, icons, text, sounds, and designs, are the exclusive property of Drawlio or its licensors and are protected by international copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 3, no rights are granted to you in the App or its content.
Reference drawings and templates provided in the App are licensed for your personal, non-commercial use as tracing guides to create your own physical artwork. Redistribution, resale, or commercial exploitation of these templates in any form is prohibited.
8. Device Permissions
The App may request access to certain device capabilities, including your camera, to provide its features. You may grant or revoke these permissions at any time through your device settings. Declining required permissions may limit or disable certain features.
9. Third-Party Services
The App integrates with third-party services, including the Apple App Store, Google Firebase, and RevenueCat. Your use of these services through the App is also subject to their respective terms and privacy policies. We are not responsible for the content, policies, or practices of any third-party service.
10. App Store Terms
You acknowledge that these Terms are between you and Drawlio, not with Apple Inc., and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. You and Drawlio acknowledge that Apple is a third-party beneficiary of these Terms and has the right to enforce them against you. Your use of the App is also governed by the Apple Media Services Terms and Conditions. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the more restrictive terms shall apply.
11. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY OUTPUTS GENERATED BY THE APP WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DRAWLIO, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, OUR LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Drawlio and its affiliates, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use or misuse of the App, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
14. Termination
We may suspend or terminate your license to use the App at any time, without notice, if we reasonably believe that you have violated these Terms or if continued provision of the App to you is likely to cause legal or operational risk. Upon termination, your right to use the App will immediately cease, but the sections of these Terms that by their nature should survive termination will continue in effect.
You may terminate these Terms at any time by uninstalling the App and ceasing all use. Termination does not entitle you to a refund of any fees already paid, except as required by law.
15. Changes to the App and to These Terms
We may update, improve, or modify the App at any time, including by adding or removing features. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws applicable in the jurisdiction in which Drawlio operates, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved in the competent courts of that jurisdiction, except where mandatory consumer protection law requires otherwise.
17. Entire Agreement and Severability
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Drawlio regarding the App and supersede all prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
